TERMS AND CONDITIONS 

 

The terms and conditions of use and access to this Citizen Notarial Portal, which hosts the Notarial Electronic Headquarters of the GENERAL COUNCIL OF NOTARIES, are as follows:

 

1. User

 

A User is understood to be any natural person who has registered on the Citizen Notarial Portal through the corresponding registration form.

Access to and use of the Citizen Notarial Portal and its contents confers the status of User (hereinafter, the “User”) and implies acceptance of each and every one of the conditions set out herein, in the version published at the time of access. The User undertakes to make diligent use of the Citizen Notarial Portal in accordance with the Law and these conditions.

Access to the Citizen Notarial Portal is free of charge, except for any costs associated with the connection through the telecommunications network provided by the access provider contracted by the User.

 

2. Description of the Services 

 

The services provided by the GENERAL COUNCIL OF NOTARIES consist of offering Users free access to and use of the Citizen Notarial Portal, through which they may obtain information on its contents and request various public notarial services via the Notarial Electronic Headquarters hosted by the portal.

Use of such services requires the User to be previously registered on the portal, and the User shall be subject to the specific conditions established for each notarial service requested.

 

3. Portal Access Systems

 

The identification systems available to registered Users for accessing the portal are as follows:

  • Credentials: identifier / password (login/password) provided during the registration process.
  • Qualified certificates (all qualified certificates issued by entities included in the European TSL are accepted).
  • Cl@ve PIN issued by the Spanish State Tax Administration Agency (AEAT).

 

4. Portal Registration 

 

Users may register on the Citizen Notarial Portal, and registration requires that they be of legal age. To this end, they must enter their personal contact details and provide all information marked as mandatory. Such information must be current, complete and truthful, and must be kept up to date throughout the use of the portal. Users shall be responsible for any false or inaccurate information provided and for any damage caused to the GENERAL COUNCIL OF NOTARIES.

The use of a password or any other means of identification to access the portal is personal and non-transferable. Users are responsible for maintaining the confidentiality of their account and for all transactions carried out through it. Users undertake not to disclose their password to third parties and to take all necessary measures to keep it confidential. Users are solely responsible for its safekeeping and for any authorised or unauthorised use by third parties.

Users are informed that accessing the portal using another User’s identity or password, as well as obtaining, using or disclosing other users’ personal data, may constitute a legal offence and, where applicable, a criminal offence.

Registered User status only allows browsing of the portal.

 

a. Private Area “User Profile”

 

Registered Users may access the private “User Profile” area to manage any changes to the information provided to the GENERAL COUNCIL OF NOTARIES, as well as their communications with it.

Access to the private “User Profile” area requires prior User registration.

b. User Deregistration

 

Registered Users may deregister from the portal at any time through the private “User Profile” area by selecting the corresponding option “I wish to deregister from this portal”.

Notwithstanding the foregoing, the GENERAL COUNCIL OF NOTARIES may deregister a User at any time if it becomes aware of misuse of the portal or breach of User obligations, where deemed necessary for the proper functioning of the portal.

5. “Accredited User” Profile

 

In order for registered Users to carry out actions or procedures available on the portal or its Notarial Electronic Headquarters—except for the selection of a notary for advice on real estate credit transactions—the User must be duly identified using one of the following accreditation systems:

  1. Notarial credential, to be obtained by appearing in person before a notary.
  2. Qualified certificates issued by entities included in the European TSL.
  3. Cl@ve PIN (AEAT).

6. User Obligations

 

Users undertake to comply with the following obligations:

  • To access and use the Citizen Notarial Portal in accordance with the Law, the access and use conditions, and generally accepted standards of morality and good conduct.
  • Not to use the portal for unlawful purposes or in a manner that may harm the rights of third parties.

7. User Liability

 

Users shall be liable for any damages or losses suffered by the GENERAL COUNCIL OF NOTARIES or the notarial community as a result of non-compliance with these access and use conditions.

8. Limitation of Liability of the GENERAL COUNCIL OF NOTARIES

 

9. Applicable Law and Jurisdiction

 

Any dispute or matter relating to the Citizen Notarial Portal shall be governed by Spanish law, and the Courts and Tribunals of the city of Madrid shall have jurisdiction.
