II. Purposes of the processing
(i) The purpose of processing the data provided through the user registration form of the Notarial Citizen Portal (PNC), where the Notarial Electronic Office is hosted, is to register the user on the portal so that they may use the services available through it.
To unsubscribe from the Notarial Citizen Portal, the user must access the “Edit profile” section and tick the box “I wish to unsubscribe from this portal”.
(ii) Likewise, please be informed that, in the case of electronic granting and authorisation by videoconference, with the intervention of a notary in certain legal acts and transactions, it will be necessary to provide the Notarial Citizen Portal with a copy, on both sides, of your National Identity Document or equivalent identification document.
The purpose of processing these data will be to communicate them to the notary designated by you for the granting and authorisation of the corresponding legal act or transaction, so that the notary may comply with the duties of identity verification and document retention established, respectively, under notarial legislation and regulations on the prevention of money laundering and terrorist financing.
(iii) Furthermore, the Notarial Citizen Portal will retain a copy of your National Identity Document if, after the granting or authorisation referred to above, you give your consent to such retention for the sole purpose of enabling the copy to be sent to the same or another notary when necessary for the granting or authorisation of any other legal act or transaction for which such copy is required. To this end, you must expressly indicate your consent by ticking the box shown at that time.
In any case, if you provide your consent, the data will be stored on the Portal in encrypted form, so that neither the General Council of the Notariat nor any notary who has not intervened in the granting or authorisation of a legal act or transaction requested by you may access it.
At any time, you may withdraw your consent by ticking the “Delete ID” box within your profile.
III. Data retention period
The data provided by citizens to the portal will be retained until they request the General Council of the Notariat to withdraw their consent to the processing of such data by ticking the box “I wish to unsubscribe from the portal” in the “Edit profile” section, and, in any case, for the period necessary to fulfil the purpose for which the data were collected and to determine any potential liabilities arising from the data processing.
IV. Lawfulness of the processing
(i) The legal basis for processing for the purpose indicated in section (i) shall be the need to retain your data in order to maintain your relationship with the Notarial Citizen Portal.
In the data collection form, fields marked with an asterisk are mandatory; therefore, if the citizen does not provide the corresponding data, the requested service may be denied.
(ii) The legal basis for processing for the purposes indicated in section (ii) shall be compliance with the legal obligations described therein.
(iii) The legal basis for processing for the purpose indicated in section (iii) shall be the consent given by you, which you may withdraw at any time.
V. Recipients
The data will not be disclosed to third parties, except to the notaries who must provide the public services available on the portal that are requested by citizens, and to any disclosures required by law.
For security reasons, in the case of electronic granting and authorisation by videoconference, the PNC will communicate, with your prior consent, the ID or TIE number to the databases of the Ministry of the Interior for the purpose of carrying out an online verification of the consistency of the data held in the ID and TIE registers of the Ministry of the Interior.
VI. Rights
The rights available to users are as follows:
